1. Who we are, and what these terms cover
Living Apothecary ("we," "us," "our") is an online-only shop selling small-batch botanical goods — tinctures, dried herbs, loose teas, salves, balms, and gift bundles — at livingapothecary.shop. By placing an order, creating an account, or using this site, you agree to these terms. If you don't agree with them, please don't purchase from us. You must be at least 18 years old (or the age of majority where you live) to place an order.
2. What our products are — and what they are not
Our products are handmade botanical preparations: herbs and flowers grown, dried, steeped, and blended in small batches. They are sold as traditional botanical goods for your personal use and enjoyment.
They are not medicine. Nothing on this site — no product name, description, email, or answer to a question — is medical advice, and none of it should be read as a claim that any product can affect your health or any condition.
These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.
3. Your use of the products is your decision
Once your order is delivered, what you do with it — including whether to ingest it, apply it, brew it, or gift it — is entirely at your own discretion and your own risk. We sell you the product; how it is used after the transaction is your choice and your responsibility.
Before ingesting or applying any botanical product, we encourage you to consult a qualified healthcare professional — especially if you are pregnant or nursing, taking any medication, managing a health condition, or considering giving a product to a child. Botanical ingredients can interact with medications and can cause allergic reactions in some people.
Please read the ingredient list on every product before use. Our tinctures contain alcohol. Our products are made in a home workshop that handles many botanicals, and trace cross-contact between ingredients is possible. If you experience irritation or any adverse reaction, discontinue use immediately and seek medical attention if needed.
4. Assumption of risk and release
By purchasing from us, you acknowledge the inherent variability of natural botanical products, accept the responsibilities described in section 3, and — to the fullest extent permitted by law — release Living Apothecary, its owner, and its workers from any claims, damages, or liabilities arising out of your use or misuse of the products after delivery.
5. Limitation of liability
To the fullest extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages arising from your purchase or use of our products or this site; and our total liability for any claim will not exceed the amount you actually paid us for the product giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these terms excludes liability that cannot be excluded under applicable law.
6. Ordering, pricing, and payment
Payment is processed securely by Stripe; we never see or store your card details. Prices are shown in U.S. dollars and may change at any time — the price you pay is the price shown at checkout. Everything is made in small batches: products can sell out, and listed quantities are limited to what the garden gave. We may cancel and fully refund any order affected by a pricing or stock error, and we reserve the right to refuse or cancel any order at our discretion (always with a full refund if you've been charged).
7. Shipping
We ship within the United States only. Orders leave our workshop within 2–3 business days. Shipping is free over the threshold shown at checkout; otherwise a flat rate applies. Once a parcel is delivered to your address, the products — and the choices about their use — are yours.
8. Returns
If something arrives broken, damaged, or isn't what you ordered, write to us within 14 days and we'll replace it or refund you. Because our goods are consumable and made in small batches, we can't accept returns of opened products.
9. Your account
If you create an account, keep your password private and your details accurate. You're responsible for activity under your account. We may close accounts that abuse the site or these terms.
10. Our content
The words, photographs, product names, and design of this site belong to Living Apothecary. Please don't reproduce them commercially without asking us first.
11. Changes to these terms
We may update these terms from time to time. The version on this page, with the date above, applies to orders placed after it's posted. Each order you place is governed by the terms in effect at the time of that order.
